These Terms and Conditions (hereinafter "Agreement") describes the terms and conditions applicable to your use of the Strenafoods web site (hereinafter "Site"), which is identified by the uniform resource locator www.strenafoods.com.

This Agreement is entered into between you as the user of the Site (hereinafter "User") and Strenafoods Limited (hereinafter "Strenafoods"). Strenafoods may revise this Agreement from time to time without notice by posting a new version of this document on the Site. All revised copies of the Policy are effective immediately upon posting. This agreement was last amended on September 18, 2006. Accordingly, the User should regularly visit the Site and review this Agreement.

By accessing, browsing and using this Site, you agree to be bound by the Agreement and all applicable law. If you do not agree to be bound by the Agreement and applicable law each time you use this Site or you do not have the authority to agree to or accept the Agreement, you may not use the site.

Orders and Pro forma invoices

Strenafoods will only accept orders made through its website. Pro forma invoices are only valid for a period of 14 days from the pro forma invoice issuing date. Every pro forma invoice issued by Strenafoods to a customer is issued subject to these Terms and Conditions. No variation or addition to these Terms and Conditions shall be binding unless first agreed to in writing between Strenafoods and its customers.

Price and Payment

The total price shall be the price indicated on the pro forma invoice. Prices do not include applicable taxes or duties. The Purchaser is solely responsible for paying all applicable taxes and duties. Pre-payment will be requested before goods are dispatched. On receipt of payment, a shipping advice will be sent (by email) and the goods will be dispatched. The shipping advice will state the estimated delivery dates.

We accept payment of pro forma invoices only by direct transfer in advance.

Delivery

The goods will be shipped to the delivery address specified in the pro forma invoice. The Customer is responsible for indicating the correct delivery address and for communicating any other information that is required to successfully deliver the goods. Incoterm used when arranging shipments is DDP-Delivered Duty Paid; Free Domicile.

Claims and Returns

Strenafoods will not accept unauthorized returns of goods. All returns must be accompanied by a return authorization document issued by Strenafoods.

Strenafoods will replace at no extra cost any goods damaged on or before delivery, provided that the Customer notifies Strenafoods of the damage in writing within 14 days from the arrival of the goods. Where outer packaging is clearly damaged, the customer shall sign the Damaged Consignment document at acceptance of delivery. Strenafoods will replace at no extra cost any goods delivered that do not match the ones stated in the pro forma invoice, provided that the Customer notifies Strenafoods of the damage in writing within 14 days from the arrival of the goods.

Order Cancellations

Orders can be cancelled by e-mailing Strenafoods at sales@strenafoods.com. The purpose of our cancellation policy is to allow a customer to withdraw from the purchase contract. Order cancellations will not be accepted for orders already shipped. Refunds will be made using the same procedure as that for payment.

Intellectual Property Rights

Each User agrees that it shall not copy, reproduce or download any information, text, images, files, directories or database available on or through the Site (hereinafter the "Strenafoods Content") for any purpose not expressly permitted in this Agreement. Strenafoods is the sole owner or lawful licensee of all the rights to the Site and the Site Content. All trade marks are the property of their respective owners.

Applicable Law

These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of Ireland applicable to agreements made and entirely to be performed within the Republic of Ireland, without resort to its conflict of law provisions. Regardless of where you access this site, you agree that any action at law or in equity arising out of or relating to these terms and conditions shall be filed and adjudicated only in the courts located in the Republic of Ireland, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction and venue of such courts over any suit, action or proceeding arising out of these terms and conditions.

Termination

Notwithstanding any of these terms and conditions, Strenafoods reserves the right, without notice and in its sole discretion, to terminate your license to use this Site, and to block or prevent future access to and use of this Site if you violate any of the terms of this Agreement.
